Can you sue when someone attacks you?
My sister was attacked my a woman and 9 other people today! This took place while she was trying to watch her little daughter ride her tricycle, and the other woman’s little girl tried to argue with my sister, to which my sister told her that she wouldn’t argue with a child. The woman was arrested, but of course she’s trying to file a counter-charge against my sister. The police don’t even believe the lady because my sis has witnesses for her defense, but they will have to let the lady make the report later.
We’re going to sign the warrant tomorrow, as well as get a PPO. But what I’m wondering is if we can sue this woman? I’m sitting at the hospital right now waiting for my sister, who mostly has damage done to her face & has pain in her head. It’s ridiculous to be attacked like this and apparently the woman is just really “ignorant” from what some neighbors say.
I want to make sure she feels the consquences of assaulting someone who didn’t deserve to have this happen.
The answer to this one is simple. Your sister will need to hire a lawyer. Your sister can probably sue for battery.
The unwanted touching by one person by another. Causation (i.e. did she hit her directly or by putting something in motion to cause the unwanted touching). And damages which can be nominal. Say $10. Then actual damages like special damages for the hospital and medicals. If the battery was intentional and designed to cause harm, then some punitives if you have some nominal damages.
Anyway, your lawyer will probably want to sue the other 9 people too.
